Estimados lectores, me parece un tema interesante hablar a grandes rasgos del funcionamiento y operación de las Donatarias Autorizadas y Reformas Fiscales, para que puedan conservar este concepto ante el SAT, ya que la omisión de alguna obligación puede causar sanciones económicas y la pérdida de ésta categoría. Así que aquí el resultado de la investigación:
Según la Ley del ISR, las Donatarias Autorizadas son organizaciones que no buscan la generación de una utilidad y trabajan en causas educativas, de salud, de investigación, culturales, ecológicas, asistenciales, obras o servicios entre otras. No son sujetas al pago del Impuesto Sobre la Renta, como lo marca el artículo 79 de la misma ley.
Existe toda una lista de beneficios con los que las Donatarias Autorizadas cuentan, entre ellos destacan que: Pueden recibir donativos ilimitados, no pagan impuestos por la importación de bienes de comercio exterior, pueden acceder a la donación de vehículos para beneficio de sus causas sociales, y a la donación de Bienes Inmuebles Donados o en Comodato, entre muchos más.
Sin embargo, obtener y conservar este permiso conlleva el cumplimiento de una serie de Obligaciones Fiscales entre las que destacan:
- Emitir la factura electrónica
- Hacer retención de impuestos
- Tener en orden su contabilidad.
- Poner a disposición del público en general la información relativa a su transparencia.
- Presentar su declaración anual
- Informar de cualquier cambio en sus estatutos.
- Destinar sus activos exclusivamente a los fines propios de su objeto social.
- Al momento de ser liquidadas o cambiar de residencia, destina la totalidad de su patrimonio a otras entidades sin fines de lucro.
- Establecer nuevas actividades relacionadas con el objeto social, pero sin fines de lucro.
El 27 de diciembre 2021 se publicó la Miscelánea Fiscal para 2022 dentro de la cual destacan Reformas Fiscales como las siguientes:
- La autorización a las organizaciones civiles y fideicomisos para recibir donativos deducibles
Regla 3.10.2. Modificación para 2022: adiciona la obligación de incorporar el complementó “Donatorios” a los CDFI que se emitan por concepto de donativos.
- Vigencia de la autorización para recibir donativos deducibles
Regla 3.10.4. Modificación para 2022: se agrega un causal de perdida y vigencia de la autorización de donataria.
- Supuestos y Requisitos para recibir donativos deducibles
Regla 3.10.5. Modificación para 2022: se elimina la posibilidad de solicitar la autorización de donataria autorizada condicionada.
- Declaración informativa para garantizar la transparencia del patrimonio y el uso y destino de los donativos recibidos y actividades destinadas a influir en la legislación
Regla 3.10.10. Modificación para 2022: Donatarias autorizadas deberán entregar avisó de transparencia en mayo 2022. Incluye aquellas que hayan solicitado suspensión de actividades y aquéllas canceladas o revocadas.
- Información sobre el destino de los donativos o del patrimonio en el caso de revocación, no revocación o cancelación de la autorización
Regla 3.10.19. Modificación para 2022.
La importancia del cumplimiento de dichas obligaciones define la conservación de este permiso, una mala asesoría en el proceso podría terminar en la cancelación de este permiso.
De más de 80 mil Organizaciones No Gubernamentales que existen en México, solo 43 mil tienen CLUNI y menos de 13 mil son Donatarias Autorizadas.
